CHESHIRE GRIN SALES CONTRACT & HEALTH GUARANTEE
This is a contract between Cat’s Pajamas ATX, LLC (hereinafter called the Breeder) and the purchaser listed below (hereafter called the Buyer). The terms listed within this contract are non-negotiable and non-transferable. All kittens will go home with age-appropriate vaccinations, spayed/neutered, dewormed, and microchipped. Each kitten will receive a vet certificate of health prior to going home and a 5-year genetic health guarantee. The Breeder will provide lifetime support and if the Buyer has questions or concerns at any time, they should feel free to reach out to the Breeder for advice.

_____ 1. The Breeder guarantees the kitten to be in good health to the best of their knowledge at the time of pickup or delivery. Buyer should be aware that during times of stress, such as moving to a new home, traveling by car or plane, or meeting new people and animals, cats can exhibit a variety of symptoms, such as sneezing, watery eyes, runny nose, lack of appetite, constipation, or diarrhea. This is completely normal and usually of short duration.

_____ 2. Buyer will take this kitten to a veterinarian for a complete health check within 48 business hours, excluding weekends and holidays. If the kitten is found to be unfit for sale due to a congenital or hereditary disorder, the Buyer may opt for one of the following:
​
· (a) The right to return the animal and receive a refund of the purchase price within 10 business days following receipt of a signed veterinary certification, excluding the veterinary costs related to the certification that the cat is unfit. The Breeder is not responsible for any return shipping expenses; or
· (b) The right to return the animal and receive an exchange cat of the Buyer’s choice of equivalent value, but not a refund of the veterinary costs related to the certification that the cat is unfit. The Breeder is not responsible for any return shipping expenses.

The Buyer must notify the Breeder within 2 business days after the veterinarian’s determination that the animal is unfit. The written certification of unfitness must be presented to the Breeder not later than 3 business days following receipt thereof by the Buyer.

*After 48 hours, Breeder cannot be held accountable for any bacterial and viral infections, infectious diseases, or parasites and fungus as these can be contracted anywhere in the environment after leaving the cattery and are not a result of genetics or breeding. The kitten may not be deemed unfit for sale due to an injury sustained or illness contracted after the Buyer takes possession of the animal. Veterinary finding of intestinal or external parasites is not grounds for declaring a kitten unfit for sale.​

_____ 3. The Buyer assumes sole responsibility for the health and well-being of the kitten from the day it arrives home until the last day of its life. As a result, it is not the responsibility of the Breeder to pay for any veterinarian expenses, treatments, or medicines that may be required to improve the life of the kitten. While everything is done to ensure that the Breeder delivers a healthy kitten there’s no way to predict the future health of any living creature, and there is always a risk it may develop a health condition in the future.

_____ 4. Kittens are sent home with a certificate for a free 30 days of Trupanion pet insurance. The Buyer must activate this insurance within 24 hours of the kitten going home. Failure to activate the insurance will render this contract null and void. It is the Buyer’s decision as to whether they wish to continue Trupanion insurance coverage after the 30-day trial has expired.

_____ 5. This kitten is guaranteed against fatal genetic defects for 5 years. Fatal genetic defects include and are limited to genetic conditions of the heart, eye, liver, and/or kidneys. If the kitten dies due to a genetic defect due to these organ systems within the first 5 years of ownership the Breeder will replace this kitten with a kitten of equal value as soon as one becomes available. In the event of a genetic defect which is a life-altering condition that may negatively affect the kitten within the first five years of life, and euthanasia is chosen as the best option for the cat due to quality of life, both the Buyer AND the Breeder must agree in writing that euthanasia is the best option. There are absolutely no exceptions to this clause. Lack of funds to provide care for a kitten is not a reason to choose euthanasia. The replacement kitten will only be given if a necropsy has been performed and a certificate from a licensed vet is provided as proof of cause of death. The cost of necropsy will be the responsibility of the Buyer.
____ 6. Buyer understands that the Breeder cannot guarantee against hypertrophic cardiomyopathy (HCM) or osteochondrodysplasia (OCD) including flexibility of the tail, fold of the ears, or cartilage problems that are associated with the fold gene. Degree of fold may change due to age, stress, and temperature. While we avoid breeding for “extreme” traits that increase a likelihood of issues associated with facial structure, stenotic nares, incorrect bites, or dental overcrowding are also not covered due to the brachycephalic nature of the breed.

_____ 7. Buyer understands that Feline Infectious Peritonitis (FIP) is not a result of breeding and is a viral disease of cats caused by certain strains of a virus called the feline coronavirus. The coronavirus is as common in cats as the common cold is in humans and normally not dangerous at all. Cats infected with coronavirus generally do not show any symptoms and it resolves itself just like the common cold. Just because a cat tests positive for coronavirus it does not mean that it has or ever will develop FIP. In approximately 10-15% of infected cats, either by mutation or an anomaly of the immune response, the infection progresses into clinical FIP. Because the coronavirus is so prevalent in domestic cats it is impossible to guarantee against it or FIP. However, as a courtesy the Breeder will cover $500 towards the cost of treatment if a kitten is diagnosed with FIP during the first year of life once the Buyer provides written confirmation of a suspected FIP diagnosis from a certified veterinarian.
_____ 8. Except for yearly FVRCP boosters and the 1-year rabies vaccination the Breeder doesn’t recommend additional vaccines. Administering the feline leukemia vaccine will void the health guarantee. Recent research has shown that the feline leukemia vaccine is ineffective and may pose various health risks.

_____ 9. If this kitten is marked as sold for breeding purposes the Buyer understands that the Breeder is not able to guarantee fertility. No refund or replacement will be provided for a lack of fertility. If the cat is unable to produce kittens it will be altered and either remain with the Buyer as a pet, returned to the Breeder, or will be placed in a loving pet home at the Buyer's discretion. The kitten will never be sold to another person with breeding rights without express written permission from the original Breeder.

_____ 10. The Buyer will provide the kitten with a safe and loving home environment. This includes adequate human attention, toys, exercise, grooming, and continued vet care for the kitten’s full lifetime. If the kitten is found to be neglected or mistreated at any point in time the Buyer reserves the full right to repossess the kitten without refund or replacement. The kitten will never be allowed to roam freely outdoors. If the kitten is outdoors, it is only accompanied by human supervision and on a lead/harness or in an enclosed safe cat habitat. The kitten will never be caged unless required for safety, during transportation, at a boarding facility, or due to veterinarian advice.

_____ 11. If the Buyer can no longer keep the kitten, they will contact the Breeder prior to rehoming. The Breeder will always be willing to take the kitten back into their care without refund if the Buyer decides to surrender the kitten by choice. The kitten will not be euthanized for any reason other than terminal illness or injuries approved by a veterinarian. The kitten will never be given or sold to an animal shelter, pet store, cat wholesaler, research facility, or donated while living for any purpose.

_____ 12. Declawing will void the health guarantee. It is a cruel practice that is now being banned in various cities throughout the United States and multiple countries. Declawing is also known to cause possible health and behavioral issues. There are alternatives to declawing such as “Soft Paws” nail caps and/or designated scratching posts.

_____ 13. Breeder reserves the right to cancel this contract at any time prior to the kitten leaving the cattery if the Breeder feels that it is in the best interest of the kitten and/or the Breeder. In that instance, the Buyer will be refunded 100% of their deposit.

​​_____ 14. The Buyer’s initials next to each point in this contract as well as the signature below signify that they have read and agree to all terms stated within this contract. The purchase amount is non-refundable and non-transferrable except under the terms listed on this contract.
